The Act ensures consumers have access to reasonable and effective remedies where the warranty on a product has been breached. It allows for informal dispute-settlement procedures and for any action brought by private parties or the government.

Rules to encourage the use of alternative dispute resolution options have been introduced to the Federal Trades Commission and the required first step in any action may be mediation and/or arbitration. This seeks to ensure an amicable and acceptable resolution to the problem without lengthy court processes.

Furthermore, the federal government is able to take injunctive action against a supplier or warrantor who breaches the condition of the act.

Consumers can seek a court hearing for violations of the Act if they have been affected by non-compliance with a warranty on the part of the vendor. If the value is over $25 the case can be heard in a federal court, or it becomes a class action if there are more than 100 claimants in a case where there has been a mass breach of warranty.
