Manufacturer And Vendor Responsibilities
The Lemon Law sets out the requirements of warranty providers and details the steps and actions they must take to fulfil their obligations to the consumer.
In the case of a defect, malfunction or failure to conform, the warrantor has several responsibilities, detailed below.
Remedy the product within a reasonable period of time and without any charge to the consumer.
Do not impose any limitation on the duration of an implied warranty.
Do not exclude or limit consequential damages for a breach of a warranty, written or implied, unless this has been clearly noted already on the face of the warranty.
Permit the consumer to choose between a refund or replacement without charge if the product or one of its parts contains a defect or malfunction and it has not been possible to fix it after a reasonable number of attempts.
The warrantor is also prohibited from imposing any duty upon a consumer as a condition of repairing the product which malfunctions, is defective or does not conform, except that of returning it to the place of purchase for inspection and repair.
